Terms and Conditions

Retainer fees are due on the day of booking to secure your date and time and are 100% nonrefundable.

I will not change my editing style for anyone, nor will I give out any RAW images.

1. Payment & Pricing: Your initial deposit holds your event date and time and is non-refundable should you no longer require my services. The deposit contract amount is due at the time of booking and the balance is due two weeks prior to the event. ** If the deposit is not paid within 48 hours of booking Nicole Grace Photography reserves the right to cancel your invoice. All package costs are stated at the time of booking and will remain the same once booking is confirmed. Upon your purchase, Nicole Grace Photography will reserve the time and date agreed upon and will not make other reservations for that time and date. For this reason, the payment is non-refundable or exchangeable.

2. I am obliged to explain the following: Upon viewing samples of my work, you have decided to invest in my services to photograph you and /or your family because you are confident that I can give you results that you will cherish. There is no knowing what photos will be produced from this endeavor simply because this is an event in the future. As an artist, I reserve the right to artistically interpret what I see and in what ways I choose to photograph a scene. This may mean that some shots are color, and some are B&W. This is my interpretation and vision as an artist.

3. Copyright: Photographs taken by Nicole Grace Photography may be used for the purposes of display, advertising, portfolio, website, or any publication to promote my business unless you request otherwise via e-mail or a hand-written statement.

4. Images: Digital images will be processed and available in an online gallery for download. Original Images are maintained for 90 days. **In the event that you do not download your photos by the expiry date, you can request a reupload of the gallery for a $75 fee.

5. Reshoot Policy: I do not offer free or discounted re-shoots on the basis of client regret over wardrobe choice, location choice, child behavior, etc.

6. Requested Coverage: Nicole Grace Photography will honor requested photographs but does not guarantee any specific photographs.

7. Torrential Weather: If the weather is torrential and the Photographer determines the shoot is not possible, the session will be rescheduled for another day.

8. Limit of Liability: Should I have an emergency and no longer be able to provide my services, I will provide a replacement photographer or refund your payment. This would only be in the case of a true emergency and is not expected to be a possibility. In the unlikely event that the Photographer cannot perform this Agreement due to a medical or natural emergency, or other cause beyond the control of the Photographer, then the Photographer shall return the deposit to the Client but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the Client’s order.

9. All parties agree to cheerful cooperation and communication for the best possible result within the definition of this Assignment. The photographer is not responsible for missed images due to any individual’s failure to appear or cooperate during the Assignment. If there is any threat to the Photographer or their equipment by any subject, Photographer reserves the right to end coverage immediately with no further liability to finish the Assignment, with no refunds given. Additionally, the Client is responsible for their own conduct and the conduct of all participants in the session. Any damage to equipment or studio components caused by the Client is the sole financial responsibility of the Client. Client agrees to hold Photographer harmless for any injuries or damages sustained preceding, during, and immediately following the Assignment.

10. Travel and Overage Fees: The photographer will travel up to 20 miles from Miami Lakes, FL for on-location sessions. If you’d like to schedule a session at a location farther from this, please request a travel quote.
